Terms of Service

These Terms govern access to and use of the Service operated by MyCustodyCoach, LLC ("MCC," "we," "us"). The Service is software that helps users organize custody-related information and draft materials using AI-assisted tools. It is not a law firm and does not provide legal representation.

1. Acceptance

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

We may update these Terms. We will post the revised Terms and update the "Last updated" date. For material changes, we will provide additional notice if required by law. Continued use after the effective date of changes constitutes acceptance unless applicable law requires otherwise.

2. The Service

The Service includes web and application features that allow you to store information, generate and edit text with AI assistance, and related productivity functions. Output may be incorrect or incomplete. The Service does not replace professional judgment or licensed legal counsel.

Other notices. Conspicuous limitations on AI output, court use, emergencies, and the fact that MCC is not a law firm are set out in our Legal Disclaimer. You agree to read that document. Processing of personal information is described in the Privacy Policy.

3. Accounts and eligibility

  • You must be at least 18 and able to form a binding contract.
  • You are responsible for account credentials and for activity under your account.
  • You must provide accurate registration information and keep it current.
  • Deletion of personal information and account data is handled as described in the Privacy Policy, subject to legal retention requirements.

4. Acceptable use

You may use the Service only in compliance with law and these Terms. You agree not to:

  • Use the Service for unlawful, harassing, or fraudulent purposes.
  • Upload content you do not have the right to share, or sealed or confidential records where you lack authority.
  • Attempt to probe, disrupt, or circumvent security or rate limits.
  • Reverse engineer or scrape the Service except to the extent applicable law permits.
  • Use the Service to build a competing model or service using our outputs in violation of Section 6.
  • Misrepresent AI-generated content as human legal work product of MCC.

We may suspend or terminate access for violations or risk to the Service or other users.

5. Fees, billing, renewal, and cancellation

  • Paid plans, prices, and taxes are presented at purchase. Fees are charged in advance unless stated otherwise.
  • Subscriptions renew automatically until you cancel in account settings or as otherwise instructed, before the renewal date.
  • We may change fees with reasonable advance notice where required by law. Continued use after a change may constitute acceptance.
  • Except where required by law, fees are non-refundable. Failed payments may result in suspension of access.
  • Payment processing is provided by our payment processor; their terms and privacy notice also apply to payment data they handle.

6. Intellectual property

MCC and its licensors own the Service, including software, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial custody-related purposes.

You retain ownership of content you submit. You grant MCC a license to host, process, and display that content solely to provide the Service, including sending portions to subprocessors as described in the Privacy Policy.

Unless we agree otherwise in writing, you may not resell, publicly redistribute, or use the Service to provide services to third parties.

7. Disclaimer of warranties

The Service is provided "as is" and "as available." To the fullest extent permitted by law, MCC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or suitable for any filing or proceeding.

8. Limitation of liability

To the maximum extent permitted by law, MCC and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or custody or legal outcomes, arising from your use of the Service or reliance on AI output, even if advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) one hundred U.S. dollars (USD $100) or (b) the amounts you paid to MCC for the Service in the twelve (12) months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.

9. Indemnity

You will defend, indemnify, and hold harmless MCC and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of law or third-party rights.

10. Dispute resolution and governing law

These Terms are governed by the laws of the State of Colorado, excluding conflict-of-law rules. Subject to applicable law and the arbitration provision below, exclusive jurisdiction and venue for disputes will be in the state or federal courts located in Colorado, and you consent to personal jurisdiction there.

Arbitration. Except for claims that may be brought in small claims court or for injunctive relief relating to intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitrator's decision may be entered in any court of competent jurisdiction.

Class action waiver. You and MCC agree to resolve disputes only on an individual basis and waive any right to participate in a class action, class arbitration, or representative proceeding.

If any part of this Section is unenforceable, the remainder remains in effect to the maximum extent permitted.

11. General

  • Entire agreement. These Terms, the Privacy Policy, and the Disclaimer (as linked) are the entire agreement between you and MCC regarding the Service.
  • Severability. If a provision is unenforceable, the remaining provisions remain in effect.
  • No waiver. Failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms without our consent. We may assign in connection with a merger or sale of assets.
  • Export. You comply with export laws and may not use the Service in embargoed jurisdictions or by prohibited persons.
